Terms of Service

The terms for using the MakeSKU website and its current frontend product-image workflow demonstrations.

Introduction

These Terms of Service govern access to and use of the MakeSKU website, account-enabled features, contact channel, deterministic editors, and configuration-gated AI studios. By using the site, you agree to these Terms. If you do not agree, do not use the site. “MakeSKU” means this website and project.

Current Product Capability

MakeSKU provides five product-image workflows:

  • Batch Product Photo Editor applies deterministic canvas, fit, position, and background settings to selected images in the browser.
  • Image Editor applies deterministic background, resize, position, and crop changes to an existing transparent subject or cutout mask. It does not perform automatic background removal.
  • Lifestyle Product Photography generates scene variations from an owned product reference and brief when the AI deployment is fully configured.
  • AI Product Ad Generator generates product-ad concepts from an owned reference, format, brief, and selected image model when configured.
  • AI Product Video Generator generates a fixed five-second product video from an owned reference and storyboard direction when configured.

The two deterministic tools do not call an AI provider or charge AI credits. The three AI tools fail closed if any required provider, callback, storage, database, or workflow configuration is missing: no provider request is sent and no credit is charged.

Using the Workflows

You may use the site only for lawful work and with material you have the right to process. You are responsible for product photos, text, names, trademarks, instructions, claims, and other input you supply. Unselected batch images are not intentionally modified. Save original files separately and review every output before publication.

AI results can contain defects, including changes to a subject, difficult edges, inconsistent text, unnatural perspective, occluding props, unstable motion, or unsuitable first and last frames. Workspace warnings and failure reasons help review these risks but do not replace human approval. MakeSKU does not promise marketplace acceptance, advertising performance, legal compliance, or error-free creative output.

Accounts and Security

Where account features are enabled, provide accurate information, protect credentials, and promptly address suspected unauthorized access. You are responsible for activity through your account to the extent permitted by law. Do not share passwords, access tokens, or API keys through the contact form.

Credits, Quotes, and Settlement

AI generation quotes are determined on the server from the requested SKU and the account’s applicable pricebook. A successful generation is charged exactly once through the ledger. Failed work follows the production settlement and refund path. Retries create traceable replacement jobs and do not authorize duplicate settlement of the original job.

The deterministic Batch and Image Editor workflows do not create an AI quote or credit charge. A visible credit estimate or plan limit applies only to the AI workflow and SKU it describes.

Pricing and Payments

The Pricing page is controlled by deployment configuration. Unless every required self-serve price ID is configured, it remains in a catalog-preview state and checkout is unavailable. A partial configuration does not activate a subset of purchase buttons. When all required price IDs are configured, the live presentation and active checkout controls appear together.

The applicable checkout page must state price, billing period, credit grant, renewal terms, expiration, taxes, and payment provider before purchase. Plan concurrency can bound the number of AI tasks in progress; Batch uses an ordered browser pipeline and does not consume AI task concurrency.

Stored Outputs and History

Configured AI jobs persist status, settlement, failure, and retry information needed for generation history. Completed outputs are copied to MakeSKU-controlled R2 storage before durable download is exposed. Temporary provider URLs are not promised as permanent storage. Browser-only deterministic state may disappear after refresh unless an explicit upload or download step preserves the result.

Contact Messages and Feedback

If you submit feedback, a question, or a collaboration proposal, you permit MakeSKU to review it and use non-confidential suggestions to evaluate or improve the product. Do not send confidential information unless separate written terms apply. Submission does not guarantee a reply, partnership, support outcome, or fixed response time.

Prohibited Conduct

You agree not to violate law, contract, privacy, publicity, intellectual-property, or other rights; submit material you lack permission to use; create deceptive, harmful, abusive, discriminatory, infringing, or illegal content; introduce malware; disrupt or scrape the service abusively; probe vulnerabilities; bypass security, readiness, pricing, credit, concurrency, or access controls; manipulate callbacks or settlement records; misrepresent an AI or deterministic output as independently verified; or interfere with infrastructure, providers, or other users.

Intellectual Property

The MakeSKU name, site design, software, interface, documentation, and original content belong to their respective rights holders. These Terms provide a limited, revocable, non-exclusive right to use the site as offered and do not transfer ownership.

You retain rights you hold in supplied product images and content. Subject to payment and plan terms where applicable, you may use delivered outputs to the extent permitted by law and by rights in the inputs and any third-party material. Marketplace names and trademarks remain their owners’ property; reference to a marketplace does not imply endorsement.

Third-Party Services

The deployment may use third parties for hosting, authentication, email, analytics, security, payment, storage, database, support, and AI generation. Their services are governed by their own terms. MakeSKU is not responsible for an external site merely because it is linked or embedded.

Availability, Disclaimers, and Liability

The site is provided on an “as available” basis. Features, providers, models, SKUs, limits, and routes may change or pause. To the extent permitted by law, MakeSKU disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted operation, and marketplace acceptance. Independently review images, claims, permissions, and platform rules before commercial use.

To the maximum extent permitted by law, MakeSKU and its contributors are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, marketplace rejection, failed publication, or reliance on an unreviewed output. Where liability cannot be excluded, it is limited only to the extent the law permits.

Suspension, Changes, and Contact

Access may be limited or terminated to protect users, providers, infrastructure, or legal rights, including for violation of these Terms. You may stop using the site at any time. These Terms may be updated as capability and connected services change; the current version and effective date will remain on this page. Questions can be sent through the MakeSKU contact page.
